If you meet the eligibility criteria, you’re invited to apply for membership to the Canon Professional Services Program (CPS Program). Canon may accept or reject any application for the CPS Program in its sole discretion. If your application is accepted, you and Canon will be bound by the terms and conditions below (Terms).

1. To join the CPS Program, you must be able to satisfy the Eligibility Criteria below:
a. be an Australian or New Zealand resident who is at least 18 years old;
b. have a valid Australian ABN or New Zealand NZBN;
c. be able to demonstrate that you own at least one Eligible Product; and
d. be (or agree to become) a MyCanon member.
2. Canon may update these Terms, the Eligible Products, and the Eligibility Criteria from time to time. We’ve set out how and when we will give you notice of any changes in clauses 37 and 38.
3. You must meet the Eligibility Criteria at all times during your membership. Your membership is granted solely to you and is not transferable.
4. You can apply to be a member by completing the application form on the CPS Website. If you need help with the form or have accessibility requirements, please contact us.
5. After you submit your application, Canon will assess your eligibility based on the information that you have provided. Canon may also carry out checks to verify your identity at this time or during the course of your membership in order for you to access the Membership Benefits (such as searches with Illion, GreenID or the government’s Document Verification Service). You consent to these checks by submitting your application to us.
6. We will review your application and email you within 5 Business Days to confirm whether it is accepted or rejected. We may reject any application for membership or renewal of membership without providing any reason.
7. If your application is accepted, you must follow the instructions in Canon’s email confirmation to select a plan and your preferred payment method within 14 days. If you do not do so, your application may lapse and you may have to submit a new application.
8. By signing up to be a member of the CPS Program, you are also opting in to receive marketing communications from Canon, including information about our products, services, promotions, and events. You can opt out or unsubscribe from marketing communications at any time by following the instructions in the communication, or by contacting Canon directly. You will continue to receive operational emails in relation to your membership of the CPS Program.
9. Membership Fees for the CPS Program are set out on the CPS Website (Membership Fee). Membership Fees for custom plans will be as agreed between Canon and you in writing prior to the commencement of the plan.
10. If your application is approved, you must follow the link provided by Canon to the CPS Portal to select your preferred plan, pay your Membership Fee either annually or monthly, and choose your preferred billing day (between the 1st and 28th day of the relevant month).
11. Canon will aim to charge you the relevant portion of your Membership Fee on or just after your preferred billing day. You can change your preferred billing day at any time during your membership.
12. Your Membership Year starts on the date that you activate your membership of the CPS Program on the CPS Portal, or (for subsequent years) on the date that your membership is renewed, and ends 1 year following the relevant start date.
13. If you choose to pay annually:
(a) We will charge you your annual Membership Fee for the first Membership Year when you activate your chosen plan on the CPS Portal.
(b) We will charge you your annual Membership Fee for each subsequent Membership Year on your chosen billing day during the first month of the subsequent Membership Year using your chosen payment method. If you change your preferred billing day during your membership, the Membership Fee payable will be adjusted pro rata over the balance of that Membership Year.
(c) You will receive a reminder by email at least 14 days prior to your renewal. If you do not want to renew your application, you can cancel the automatic renewal in the CPS Portal at any time before the Membership Fee for the subsequent Membership Year is charged by Canon. Once the charge has been made for the subsequent year, the Membership Fee is not refundable unless otherwise stated in these Terms or under Consumer Law.
(d) If the automatic renewal option in the CPS Portal is disabled, your membership will end on the last day of the relevant Membership Year.
14. If you choose to pay monthly:
(a) We will charge you your monthly Membership Fee for the first month of your membership when you activate your chosen plan on the CPS Portal.
(b) Unless you have disables the automatic renewal on your account, we will charge you the monthly Membership Fee payable for each subsequent month on the first day of the following month using your chosen payment method.
(c) Once the charge has been made, the Membership Fee is not refundable unless otherwise stated in these Terms or under Consumer Law.
(d) Your membership will end on the last day of your billing month unless you renew your subscription by paying the Membership Fee payable for the next month.
15. All renewals are subject to you continuing to meet the Eligibility Criteria. If Canon becomes aware that you no longer meet any of the Eligibility Criteria at any time during your membership, we will inform you and may suspend your membership until you have rectified the issue.
16. If you are not able to rectify the issue with your Eligibility Criteria within 14 days after Canon notifies you that you no longer meet the Eligibility Criteria:
(a) your membership will be cancelled;
(b) you will no longer be entitled to use any of your Membership Points, and will not receive a refund of any Membership Fee already paid;
(c) you will remain liable to pay any fees that you have already incurred (for example, for repairs or servicing); and
(d) any items loaned to you under the CPS Program must immediately be returned to Canon.
17. You are responsible for any fees incurred by Canon for failed transactions due to incorrect information that you have provided.
18. In exchange for your Membership Fee, you will be given access to the following categories of Membership Benefits:
(a) Membership Points
(b) Service Replacement Loans
(c) Experience Loans
(d) Sensor Cleans
(e) Discounted and prioritised repairs
19. All members will require a valid GreenID check prior to accessing any loans or repair services. The GreenID check will be carried out through the CPS Portal, and will be valid for 1 year.
20. You cannot exceed the maximum number of Membership Points permitted for your Membership Plan at any time during a Membership Year. At the end of the relevant Membership Year (for annual subscription plans) or the relevant month (for monthly subscription plans), any Membership Points that are not used will only be rolled over to the new term if you renew your membership.
21. If you renew your membership and the Membership Points allocated for your new membership plus your existing Membership Points exceed the maximum number of points allowed for your Membership Plan, your Membership Points will be capped to the maximum number allowed for your Membership Plan.
22. You must register your Eligible Products in the CPS Portal. Once the Eligible Product is registered, it must be assigned in the CPS Portal before the Membership Benefits will apply to it. You may swap which Eligible Products are covered under the CPS Program. The number of product swaps available will depend on your membership tier.
23. Membership Benefits apply in addition to any rights that you have under Consumer Law, or an applicable express warranty.
24. Each Membership Benefit is further described and subject to the terms and conditions below:
A. Membership Points
• When you sign up to the CPS Program, you will be allocated the number of Membership Points that correlates to your Membership Plan.
• You can use your Membership Points to redeem Membership Benefits such as Product Swaps, Sensor Cleans, and Experience Loans. If you use your Membership Points to book in a service and elect not to continue with the service, Canon is not obliged to reverse the transaction and refund your points to you.
• Membership Points for members who pay monthly will automatically be allocated at the start of each month following payment of your Membership Fee.
• Membership Points for annual memberships will automatically be allocated at the start of each Membership Year.
• When your membership is cancelled, expires or ceases for any reason, you will forfeit all points linked to your Membership and can no longer be able to access any Membership Benefits.
• Membership Points are not refundable, transferable or exchangeable for cash.
B. Service Replacement Loans
• Service Replacement Loans provide temporary, like-for-like or similar equipment loans when your Eligible Products are being repaired under the CPS Program.
• Service Replacement Loans are only available if you send your Eligible Product to Canon for servicing or repairs.
• If you are eligible for a Service Replacement Loan, you can check the availability of your required product on the CPS Portal before sending your Eligible Product to us for repair or servicing.
• Canon will aim to process requests for Service Replacements Loans within 2 Business Days.
• If you request a Service Replacement Loan but do not within a reasonable time: (a) send us your Eligible Product for repair; (b) respond to a quote or request for information required to carry out the repair; (c) pay for the completed repair or servicing within the time requested on Canon’s invoice; or (d) return the loaned product by the agreed return date; Canon reserves the right to suspend your access to the CPS Program until you rectify the issue.
C. Experience Loans
• The purpose of Experience Loans is to allow CPS Program members to trial eligible newly released Canon products for a limited time prior to purchasing those products.
• You must not use products loaned to you via Experience Loans for commercial purposes.
• In order to avoid any misuse and to give all members a fair chance to access Experience Loans, Canon reserves the right to reject requests for Experience Loans: (a) that exceed 2 times per product type in a Membership Year; or (b) where the member requesting the loan already owns the product requested.
• The products available for Experience Loans are divided into different tiers. You must pay the amount of Membership Points assigned to the relevant tier for the product that you are requesting.
D. Sensor Cleans
• CPS members may access professional sensor cleans on applicable Eligible Products.
• The number of Sensor Cleans available will vary depending on your Membership Plan, and will be set out on the CPS Website.
E. Discounted and prioritised repairs
• CPS Program members will receive a discounted parts and labour rate for repairs and services of selected Eligible Products based on their Membership Plan.
• Canon will prioritise repairs and servicing of Eligible Products owned by members of the CPS Program, however turnaround times are dependent on the availability of parts, shipping delays and the technical complexity of the repair or service required.
• Some Eligible Products may not be repairable if Canon is unable to source the parts required from the manufacturer (for example, if the manufacturer is no longer offering support for a particular product).
F. Technical support
• Members of the CPS Program will receive two levels of support for resolution of their challenges: L1 – Support team at Canon’s call centre to respond to calls and emails. L2 – Support from the CPS Program team.
• CPS Program members can track the progress of repairs to their Eligible Products through the CPS Portal.
Additional terms applicable to all Loans
25. Canon will cover the one-way transportation costs to send the loaned product to you. You are responsible for returning the loaned product safely to Canon. If you are unable to return the loaned product in person, you must arrange a secure method of transport (such as courier or registered post) at your expense unless otherwise agreed in writing by Canon.
26. The loan period will be set out in the CPS Portal, and the loaned product must be returned to Canon in person at the listed location or marked as shipped by a courier or registered post to that location
by 4.00 pm on the last day of the loan period.
27. If you do not return a loaned product when it is due, Canon reserves the right to:
(a) charge you a late fee. The current late fee is $400 per week for cameras and $200 a week for lenses;
(b) suspend your access to the CPS Program until you return the loaned product to Canon; and/or
(c) deduct the amount of Membership Points from your account that would be payable to borrow the loaned product for each day that it is overdue, until it is returned to Canon. Membership Points that are deducted under this clause 27 will not be refunded on return of the loaned product to Canon.
28. If any loaned product is not returned to Canon within 30 days of the due date, it will be deemed to have been purchased by you, and you must pay Canon on demand an amount equal to the current professional retail price of the loaned product (including GST).
29. Cancellations of loans must be advised at least 24 hours prior to the commencement of the loan period, or a cancellation fee may be charged.
30. During the loan period (and any extension of it) you:
(a) must not permit any third party to use or take possession of the loaned product;
(b) must not, and must not permit any third party to, modify or repair the loaned product;
(c) must use the loaned products in accordance with Canon’s instructions; and
(d) must contact Canon and follow our instructions if the loaned products require any maintenance or repair.
31. You acknowledge that the loaned product will be in good order and condition at the commencement of the loan period, except for any defect or damage acknowledged in writing by Canon. You must return the loaned product to Canon in the same order and condition.
32. You are responsible for any loss of or damage to the loaned products during the loan period (including by third parties), from the time that it is delivered to you until it is received by Canon. You must use best efforts to protect all loaned products from shock, impact, water damage, sand, dirt and other substances that may damage the loaned product.
33. You indemnify Canon against any loss of or damage to the loaned product during the loan period, including during transit to Canon. Unless otherwise agreed, you are responsible for arranging appropriate insurance for the loaned product for any damage caused to it (including by third parties) for the loan period.
34. If you use your points to book in a Service Replacement Loan or Experience Loan and elect not to continue with the service, Canon is not obliged to reverse the transaction and refund your points to you.
35. Canon reserves a selection of equipment for the Service Replacement Loan and Experience Loan programs based on typical demand and the number of CPS Program members. You agree that access to any loan equipment under the CPS membership program is subject to availability, and on a first come, first serve basis. There may be times when the equipment that you wish to borrow is not available.
36. If any loaned products are damaged during a loan, you must reimburse us for the cost of repairing them within 30 days of receiving an invoice from us. If you do not pay the repair cost within this time, you authorise us to charge the cost of the repair to your debit or credit card on our file where we have your written authorisation to do so.
37. Canon reserves the right to cancel the CPS Program or to modify these Terms, the Membership Benefits, or Membership Fees at any time. Canon will notify CPS Program members of any material changes by updating the CPS Website and by emailing members prior to the changes taking effect.
38. From time to time, Canon will update the list of Eligible Products in the CPS Portal and the CPS Website by adding new products or deleting existing products. From the time of the update, if you have a product that is registered on the CPS Portal as an Eligible Product which is being deleted, you must contact the CPS team to continue to receive Membership Benefits on that product, and you can count that product towards your eligibility for membership until the later of:
a. the end of your current Membership Year; or
b. 6 months from the date of the update.
39. Canon may cancel your membership immediately if at any time Canon determines (in its reasonable
discretion) that:
a. you fail to meet or no longer meet the Eligibility Criteria;
b. you have breached these Terms; or
c. you have been aggressive, intimidating or used offensive language towards Canon staff or Canon’s customers at a Canon site.
40. If you are eligible for a refund, Canon will process the refund within 10 Business Days. The time that it takes for the refund to appear on your statement or in your account (as applicable) is dependent on your provider and your chosen payment method.
41. By applying for and participating in the CPS program, you are deemed to consent to Canon collecting personal information about you for the purpose of running the CPS Program. Canon may, for this purpose, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
42. Personal information collected by Canon in connection with the CPS program will be managed in accordance with its Privacy Policy at https://www.canon.com.au/privacy-policy, which contains information about access, correction and complaint processes., which contains information about access, correction and complaint processes.
43. It is your responsibility to update your membership information, including without limitation, your chosen payment method and your email address, so that your membership stays current and you receive important communications from Canon about your membership.
44. You must keep your CPS Portal password safe and secure, and not disclose it to any third party.
45. Canon does not store your credit card information. Your credit card information is handled and stored by Stripe, a specialised gateway provider in compliance with PCI data security standards. Stripe collects and stores personal information with encryption in accordance with its Privacy Policy at https://stripe.com/au/privacy.
46. Canon does not exclude or limit the application of any provision of any applicable statute (including Consumer Law) where to do so would contravene that statute, or cause any clause in these Terms to be void. Except for any liability that cannot by law be excluded, Canon is not responsible for and excludes all liability for any personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the CPS Program.
47. Subject to clause 46 and to the fullest extent permitted by law, Canon’s liability to you arising out of, or in connection with the CPS program or these Terms is limited to the resupply of the applicable CPS Membership Benefit/s, paying for the cost of resupply, or the refund of your membership fees for the Membership Year.
48. You warrant to Canon that all information you supply to Canon in connection with your application and your membership is true and correct.
49. The failure by Canon to enforce any of its rights at any stage does not constitute a waiver of those rights.
50. These Terms are governed by the laws of the relevant Jurisdiction, and the parties you submit to the non-exclusive jurisdiction of the relevant courts in the Jurisdiction.
51. Any reference to currency or monetary amounts in these Terms are a reference to the currency used in the relevant Jurisdiction.
52. In these Terms, capitalised terms have the corresponding meanings listed below:
Consumer Law means (as applicable) Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth), the Competition and Consumer Act 2010 and the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Business Day means any day that is not a Saturday, Sunday, public holiday or a day that the CPS Program is open for trade in the Jurisdiction.
Canon, us or we means the relevant Contracting Entity in the Jurisdiction.
Contracting Entity means the relevant entity entering into these Terms with you, as described in the table set out in the definition of Jurisdiction.
CPS Portal means the portal for the CPS Program for members to access the Membership Benefits and other CPS Program services.
CPS Program means the Canon Professional Services program that is subject to these Terms.
CPS Website means the CPS website for Australia and New Zealand (as applicable, based on the resident country of the member).
Currency means the currency applicable to the Jurisdiction.
Eligibility Criteria means the eligibility criteria for the CPS Program listed in clause 1.
Eligible Products means any genuine repairable Canon-branded products that Canon is able to
obtain parts for from the manufacturer (as determined by Canon, acting reasonably), as listed on the CPS Website.
Individual Memberships mean any individual membership plan available under the CPS Program.
Jurisdiction means the relevant jurisdiction that applies to these Terms according to the table below, as determined by the location of a member’s residence at the time that their membership commences:

Membership Benefits means the membership benefits described in clause 18.
Membership Fee means the applicable membership fee for the relevant Membership Plan.
Membership Plan means the relevant membership plan described on the CPS Website.
Membership Points are credits that Canon issues to members of the CPS Program.
Membership Year means the duration defined in clause 12.
Team Memberships mean any team membership plan for the CPS Program.
Terms means these terms and conditions for the CPS Program.
