Terms and Conditions (Terms)
1. These terms and conditions govern the participation in this Canon Advantage Chance to Win Competition (Competition). Information and instructions on how to participate form part of these Terms.
2. Participation in this Competition is deemed acceptance of these Terms.
3. By communicating this Competition to Participants (as defined in clause 7 below), photo specialty retailers in Australia and New Zealand who are registered in the Canon Advantage Training Portal (Portal) (Retail Partners) agree to be bound by these Terms, and to ensure that Participants comply with these Terms.
4. This Competition starts at 9:00am AEST on 1 July 2025 and ends at 5:00pm AEST on 31 December 2025 (Competition Period).
5. There are various promotions and prizes available during the Competition Period. Participants must follow the instructions listed in these Terms for each Promotion to win the relevant prize available for a particular period.
6. Participants consent to receiving marketing communications and information from the Promoter regarding the latest offers and promotions for Canon products and services. Participants may opt out of communications at any time.
Eligibility
7. This Competition is only open to individual Australian and New Zealand residents who:
a. are employees or contractors engaged in a sales, customer service or retail management role in a Retail Partner;
b. have received a link from the Promoter to the Portal; and
c. have successfully enrolled as a Participant on the Portal (Participants).
8. OfficeWorks employees and contractors are not eligible to take part in this Competition.
9. Participants who are under the age of 18 must have the written consent of their parent or legal guardian to enter this Competition.
How to Enter
10. From 1 June 2025, the Promoter will announce the Competition by displaying promotional materials at the Retail Partners’ in-store locations, and a video on the Portal.
11. To enter this Competition, Participants must follow the instructions listed for each Promotion during the Competition Period (Entry).
12. Only one Entry per person is permitted for each Promotion.
JULY – AUGUST 2025
Adobe Promotion
13. The total prize pool for the Adobe Promotion is valued at AUD $4,318.80. Each Participant who completes the Canon Adobe Promotion plan in the Portal from 1 July 2025 to 31 August 2025 will automatically be entered into the draw for the Adobe Promotion.
14. Participants who have won an Adobe prize in any Canon promotion in April 2025, May 2025 or June 2025 are not eligible to win the Adobe Promotion. If their names are drawn in the first draw, they will not win a prize as they are disqualified from this Promotion. The Promoter will draw an alternate winner at random from the rest of the Entries within 7 days of being notified by Adobe that the Participant drawn is not eligible for this Promotion.
15. Winners of the Adobe Promotion can choose a prize of either:
a. a 12-month subscription for Adobe Creative Cloud Photography 1TB (RRP AUD $371.88 per year); or
b. a 12-month subscription for Adobe Premier Pro (RRP AUD $431.88 per year)
(Adobe Promotion Prize).
16. The Adobe Promotion is a game of chance. Subject to clause 14, the first 8 Participants from Australia and the first 2 Participants from New Zealand drawn at random will each win an Adobe Promotion Prize.
17. The draw for the Adobe Promotion will take place at 3:00pm AEST on 5 September 2025 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
18. The winners for the Adobe Promotion will be notified in writing by 5:00pm (AEST) on 12 September 2025.
19. Winners must respond to the Promoter’s notification within 14 days and provide any details requested including their choice of Adobe Promotion Prize. The Promoter is not obliged to entertain any change of mind requests in relation to the choice of Adobe Promotion Prize selected.
20. The Promoter will deliver the Adobe Promotion Prize in accordance with clause 66.
21. If a prize for the Adobe Promotion is forfeited by a winner for any reason (including by not providing a correct delivery address for the Prize to be delivered to, or not providing suitable proof of their eligibility), or if a winner does not claim their prize within 14 days in accordance with the Promoter’s instructions, the Promoter will conduct a secondary draw for an alternate winner at 3:00pm AEST on 30 September 2025 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority. Winners of the secondary draw will be notified in writing within 7 days of the secondary draw taking place.
22. The Promoter will publish the last name, initial of the first name and postcode of each winner and alternate winner who is a South Australian resident (except for any winner who has requested that their name and postcode not be published) on the Portal. Winners may request that their last name, first initial and postcode are not published, and the Promoter must abide by this request.
UberEats Promotion
23. The total prize pool for the UberEats Promotion is AUD$3,000 for Australia and NZD$1,500 for New Zealand. Each Participant who completes any three (3) plans in the Portal from 1 July 2025 to 31 August 2025 will automatically be entered into the draw for the UberEats Promotion.
24. The prize for the UberEats Promotion is a AUD$100 UberEats voucher for Australian winners, or a NZD$100 UberEats voucher for New Zealand winners (UberEats Promotion Prize).
25. The UberEats Promotion is a game of chance. The first 30 Participants from Australia and the first 15 Participants from New Zealand drawn at random will each win an UberEats Promotion Prize.
26. The draw for the UberEats Promotion will take place at 3:00pm AEST on 5 September 2025 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
27. The winners of the UberEats Promotion will be notified in writing by 5:00pm AEST on 12 September 2025.
28. The Promoter will deliver the UberEats Promotion Prize in accordance with clause 66.
29. If a prize for the UberEats Promotion is forfeited by a winner for any reason (including by not providing a correct delivery address for the Prize to be delivered to, or not providing suitable proof of their eligibility), or if a winner does not claim their prize within 14 days in accordance with the Promoter’s instructions, the Promoter will conduct a secondary draw for an alternate winner at 3:00pm AEST on 30 September 2025 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
30. Winners of the secondary draw will be notified in writing within 7 days of the secondary draw taking place. The Promoter will publish the last name, initial of the first name and postcode of each winner and alternate winner who is a South Australian resident (except for any winner who has requested that their name and postcode not be published) on the Portal. Winners may request that their last name, first initial and postcode are not published, and the Promoter must abide by this request.
Canon Cinema Hoodie Promotion
31. The total prize pool for the Canon Cinema Hoodie Promotion is valued at AUD $967.60. Each Participant who completes the Canon ‘Eye and Mind’ plan in the Portal from 1 August 2025 to 31 August 2025 will automatically be entered into the draw for the Canon Cinema Hoodie Promotion.
32. The prize for the Canon Cinema Hoodie Promotion is a Canon Cinema Hoodie (RRP $120.95 AUD) (Canon Cinema Hoodie).
33. The Canon Cinema Hoodie Promotion is a game of chance. The first 5 Participants from Australia and the first 3 Participants from New Zealand drawn at random will each win a Canon Cinema Hoodie.
34. The draw for the Canon Cinema Hoodie Promotion will take place at 3:00pm AEST on 5 September 2025 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
35. The winners for the Canon Cinema Hoodie Promotion will be notified in writing by 5:00pm (AEST) on 12 September 2025.
36. The Promoter will deliver the Canon Cinema Hoodie in accordance with clause 67.
37. If a prize for the Canon Cinema Hoodie Promotion is forfeited by a winner for any reason (including by not providing a correct delivery address for the Prize to be delivered to, or not providing suitable proof of their eligibility), or if a winner does not claim their prize within 14 days in accordance with the Promoter’s instructions, the Promoter will conduct a secondary draw for an alternate winner at 3:00pm AEST on 30 September 2025 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
38. Winners of the secondary draw will be notified in writing within 7 days of the secondary draw taking place. The Promoter will publish the last name, initial of the first name and postcode of each winner and alternate winner who is a South Australian resident (except for any winner who has requested that their name and postcode not be published) on the Portal. Winners may request that their last name, first initial and postcode are not published, and the Promoter must abide by this request.

Canon Duffle Bag Promotion
39. The total prize pool for the Canon Duffle Bag Promotion is valued at AUD $11,246.25. Each Participant who completes three (3) plans in the Portal from 1 September 2025 to 31 October 2025 will automatically be entered into the draw for the Canon Duffle Bag Promotion.
40. The prize for the Canon Duffle Bag Promotion is a Canonbranded duffle bag (RRP $149.95 AUD) (Canon Duffle Bag).
41. The Canon Duffle Bag Promotion is a game of chance. The first 50 Participants from Australia and the first 25 Participants from New Zealand drawn at random will each win a Canon Duffle Bag.
42. The draw for the Canon Duffle Bag Promotion will take place at 3:00pm AEST on 7 November 2025 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority. If a secondary draw is required, it will be conducted in accordance with clause 1.a. 43. The winners for the Canon Duffle Bag Promotion will be notified in writing by 5:00pm (AEST) on 13 November 2025.
44. The Promoter will deliver the Canon Duffle Bag in accordance with clause 67.
45. If a prize for the Canon Duffle Bag Promotion is forfeited by a winner for any reason (including by not providing a correct delivery address for the Prize to be delivered to, or not providing suitable proof of their eligibility), or if a winner does not claim their prize within 14 days in accordance with the Promoter’s instructions, the Promoter will conduct a secondary draw for an alternate winner at 3:00pm AEST on 28 November 2025 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority. Winners of the secondary draw will be notified in writing within 7 days of the secondary draw taking place.
46. The Promoter will publish the last name, initial of the first name and postcode of each winner and alternate winner who is a South Australian resident (except for any winner who has requested that their name and postcode not be published) on the Portal. Winners may request that their last name, first initial and postcode are not published, and the Promoter must abide by this request.
NOVEMBER – DECEMBER 2025
Visa Gift Card Promotion
47. The total prize pool for the Visa Gift Card Promotion is AUD$3,000 for Australia and NZD$1,500 for New Zealand. From 1 November 2025 to 31 December 2025, each Participant who completes three (3) plans in the Portal will automatically be entered into the draw for the Visa Gift Card Promotion.
48. The prize for the Visa Gift Card Promotion is a Visa digital gift card with a value of AUD$100 for Australian winners, or NZD$100 for New Zealand winners (Visa Gift Card Prize).
49. The Visa Gift Card Promotion is a game of chance. The first 30 Participants from Australia and the first 15 Participants from New Zealand drawn at random will each win a Visa Gift Card Prize.
50. The draw for the VISA Gift Card Promotion will take place at 3:00pm AEST on 7 January 2026 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority. If a secondary draw is required, it will be conducted in accordance with clause 1.a.
51. The winners for the VISA Gift Card Promotion will be notified in writing by 5:00pm (AEST) on 13 January 2026.
52. The Promoter will deliver the VISA Gift Card Prize in accordance with clause 66.
53. If a prize for the VISA Gift Card Promotion is forfeited by a winner for any reason (including by not providing a correct delivery address for the Prize to be delivered to, or not providing suitable proof of their eligibility), or if a winner does not claim their prize within 14 days in accordance with the Promoter’s instructions, the Promoter will conduct a secondary draw for an alternate winner at 3:00pm AEST on 29 January 2026 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
54. Winners of the secondary draw will be notified in writing within 7 days of the secondary draw taking place. The Promoter will publish the last name, initial of the first name and postcode of each winner and alternate winner who is a South Australian resident (except for any winner who has requested that their name and postcode not be published) on the Portal. Winners may request that their last name, first initial and postcode are not published, and the Promoter must abide by this request.
Store Team Promotion
55. The total prize pool for the Store Team Promotion is AUD$3,000 for Australia and NZD$1,500 for New Zealand. The prize for the Store Team Promotion is a Visa digital gift card with a value of AUD$500 for Australian winners, or NZD$500 for New Zealand winners (Store Team Prize).
56. The Retail Partners in the locations listed in the table below with the highest number of plan completions by store, divided by the number of users registered in the Portal for that store, from 1 November 2025 to 31 December 2025 will each win a Store Team Prize. If multiple have reached 100%, the winner will be the first who reached it.

57. Despite clause 56, the Store Team Prize for South Island will be won by the stores with the top 2 highest number of plan completions by store, divided by the number of users registered in the Portal for that store, from 1 November 2025 to 31 December 2025. If multiple have reached 100%, the winners will be the first 2 stores who reached it.
58. The Promoter will inform the manager of the winning stores in writing by 5:00pm (AEST) on 13 January 2026.
59. The Promoter will deliver the Store Team Prize to the manager of the winning stores in accordance with clause 66.
60. If a winner of the Store Team Promotion forfeits their prize for any reason, or does not claim their prize in accordance with the Promoter’s instructions, the Promoter will select the next Retail Partner who achieves the criteria set out in clause 56 or 57 (as applicable) as the alternate winner within 14 days of the winner forfeiting or not claiming their prize.
Judging
61. The following Promotions are games of chance and the winners will be selected by random draws:
a. Adobe Promotion;
b. UberEats Promotion;
c. Canon Cinema Hoodie Promotion;
d. Canon Duffle Bag Promotion; and
e. Visa Gift Card Promotion.
62. The Promoter will decide the winners of each promotion of skill in accordance with these Terms. The Promoter's decision is final, and no correspondence will be entered into.
63. No responsibility is accepted for any Entry that is late, lost or misdirected, or if a winner does not claim their Prize in accordance with these Terms.
Claiming the Prizes
64. The Promoter will notify the winners of every draw in each Promotion in writing of the result of the draw within seven (7) days of the draw.
65. The winners of each Promotion must provide their correct names and email addresses to the Promoter in writing to claim their prize.
66. Where possible, the Promoter will send the prizes to the winners of each Promotion by email within 3 weeks of notifying the relevant winner of their win.
67. Where any prize cannot be emailed, the Promoter will send it by registered post or by hand to the Retail Partner that the winner is registered with in the Portal within 3 weeks of notifying the relevant winner of their win.
68. The Promoter will send a tracking number to the relevant winner within 14 business days of posting the prize. The winner agrees to acknowledge delivery of the Prize by signing an acknowledgement of receipt.
69. The Promoter has no control of and is not responsible for any delays or issues arising from the use of any postal carrier.
70. The names of the winners will be given to the Retail Partner’s head office. Each winner consents to the Retail Partner and Promoter publishing their name in an announcement on the Promoter’s ‘Canon Advantage Channel’ located in the Portal within 30 days of the winners being drawn.
71. No responsibility is accepted by the Promoter for any Entry that is late, lost or misdirected, or if a Prize Winner does not claim their Prize in accordance with these Terms.
Participant’s Warranties and Indemnity
72. The Promoter is not liable for any costs and claims in connection with a failure by itself to comply with these Terms.
73. Each Participant agrees that they are fully responsible for each Entry they submit. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.
74. This Competition is in no way endorsed, sponsored or affiliated with Myagi Software. The Promoter is not liable for any costs and claims arising in connection with a failure by Myagi Software service provider to comply with these Terms, or otherwise arising in connection with this Competition.
75. Participants agree the Prize may be regarded as benefits inkind and be liable to taxes, including fringe benefits tax. Participants and their employer are liable for all such taxes. The Promoter recommends Participants and the Retail Partner obtain independent tax advice in this regard.
76. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Myagi software.
Conditions that may Invalidate Entries, Participants or the Competition
77. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.
78. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.
79. The Promoter reserves the right to disqualify any Participant it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Terms.
80. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Privacy
81. The Promoter collects personal information in order to conduct this Competition. The Promoter may, for the purpose of conducting this Competition, disclose such information to third parties, including agents, contractors, service providers, suppliers and, as required, to regulatory agencies. Participation is conditional on providing this information.
82. Information about Participants may be published as set out in these Terms. Personal information collected by the Promoter will be managed in accordance with its Privacy Policy (www.canon.com.au/Privacy-Policy or www.canon.co.nz/privacy-policy).
Liability
83. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) the Consumer Guarantees Act 1993 (NZ) or similar consumer protection laws in the States and Territories of Australia and in New Zealand (Non-Excludable Guarantees).
84. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Participant; or (e) use of the Gift.
General
85. These Terms may change, and the Promoter will inform Participants in writing of any changes as soon as reasonably possible.
86. The Promoter will use reasonable efforts to ensure that the timeframes specified in these Terms are met, but Participants accept that time frames may vary due to circumstances outside the Promoter’s reasonable control, including but not limited to postal delays or delays in bank processing.
87. Unless otherwise expressly stated in these Terms, all money amounts in these Terms are in Australian Dollars inclusive of GST.
88. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.
89. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.

How to Enter

9. To enter this Competition, Participants must (during the Competition Period) (Entry):
a. complete the PowerShot V1 Training Plan and the EOS R50 V Training Plan on the Portal (each a Training Plan); and
b. achieve a score of 100% on the quiz at the end of each Training Plan.
10. Only one Entry is permitted per person.
Judging
11. This Competition is a game of chance, and the first two (2) valid Entries drawn at random will win a Prize (as defined in clause 13 below) (Winners).
12. The draw will take place at 3:00pm AEST on 7 July 2025 at the head office of the Promoter at Building A, The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
Prize
13. There are 2 x Canon EOS R50 V cameras to be won (each valued at AUD RRP$1499) (each a Prize).
Claiming the Prize
14. The Promoter will notify the Winners in writing of the result of the draw within seven (7) days of the draw.
15. The Winners must provide their correct names, email and delivery addresses to the Promoter in writing to claim their Prize.
16. The Promoter will (at its election) either post the Prize to each Winner via registered post, or the Promoter’s local field representative will deliver them to the Winner in person.
17. If posted, the Promoter will send a tracking number to the Winner within 14 business days, and the Winner agrees to acknowledge delivery of the Prize by signing an acknowledgement of receipt.
18. The Promoter has no control of and is not responsible for any delays or issues arising from the use of any postal carrier.
19. The names of the Winners will be given to the Retail Partner’s head office. Each Winner consents to the Retail Partner and Promoter publishing their name in an announcement on the Promoter’s ‘Canon Advantage Channel’ located in the Portal within 30 days of the Winners being drawn.
20. If a Winner:
a. does not, within fourteen (14) days of being drawn, claim their Prize according to the instructions specified in the Promoter’s email (including by not providing a correct delivery address for the Prize to be delivered to); or
b. cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Prize in its entirety and the Promoter will choose an alternate Winner at random via a draw from the rest of the Entries at their sole discretion.
21. If a Winner forfeits the Prize, a secondary draw may take place at 3:00pm AEST on 20 July 2025 at the head office of the Promoter at The Park Estate, 5 Talavera Road, Macquarie Park NSW 2113, subject to any directions from a regulatory authority.
22. No responsibility is accepted by the Promoter for any Entry that is late, lost or misdirected, or if a Prize Winner does not claim their Prize in accordance with these Terms.

Liability
34. Nothing in these Terms limits, excludes or modifies or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition including (but not limited to) out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; ( d) any tax liability incurred by a Participant; or (e) use of the Gift.
General

39. If any provision of these Terms is unenforceable for any reason, such provision shall be severed from these Terms and the remaining Terms will remain in full force and effect.
40. These Terms are governed by the laws in New South Wales. All Participants submit to the non-exclusive jurisdiction of the Courts of New South Wales.

Terms and Conditions (Terms)
1. These terms and conditions govern the participation in this Canon Advantage Limited Edition T-Shirt Offer (Promotion). Information and instructions on how to participate form part of these Terms.
2. Participation in this Promotion is deemed acceptance of these Terms.
3. By communicating this Promotion to Participants (as defined in clause 6 below), photo specialty retailers in Australia and New Zealand who are registered in the Canon Advantage Training Portal (Portal) (Retail Partners) agree to be bound by these Terms, and to ensure that Participants are bound by these Terms.
4. This Promotion starts at 9:00am AEST on 1 May 2025 and ends at 5:00pm AEST on 30 June 2025 (Promotion Period).
5. Participants consent to receiving marketing communications and information from the Promoter regarding the latest offers and promotions for Canon products and services. Participants may opt out of communications at any time.
Eligibility
6. This Promotion is only open to individual Australian and New Zealand residents who:
a. are employees or contractors engaged in a sales, customer service or retail management role in a Retail Partner;
b. have received a link from the Promoter to the Portal; and
c. have successfully enrolled as a Participant on the Portal, (Participants).
7. Participants who are under the age of 18 must have the written consent of their parent or legal guardian to enter this Promotion.
How to Enter
8. From 1 May 2025, the Promoter will announce the Promotion through promotional materials displayed at the Retail Partner’s in-store location, and a video on the Portal.
9. To enter this Promotion (Entry) and win the Gift (as defined in clause 11 below), a Participant must complete the PowerShot V1 and EOS R50 V training plans in the Portal during the Promotion Period (Winner).
10. Only one Entry is permitted per person.
Gift
11. Each Winner will receive a free limited-edition PowerShot V1 t-shirt valued at AUD RRP$49.95 (Gift).
12. The Gifts are limited to 1,500 for Australian Winners, and 300 for New Zealand Winners.
Claiming a Gift
13. The Promoter will (at its election) either post or hand deliver the Gift to each Winner.
14. Winners will receive written confirmation of their win from the Promoter by 13 July 2025. To claim their Gift, each Winner must respond to the Promoter within the time requested in the written confirmation and provide their correct name, email and delivery address.
15. If the Gift is posted, the Promoter will send a tracking number to the relevant Winner within fourteen (14) business days.
16. The Winner agrees to acknowledge delivery of the Gift by signing an acknowledgement of receipt.
17. The Promoter has no control of and is not responsible for any delays or issues arising from posting the Gifts or from late or incorrect information being provided by the Winner.
18. If the Winner cannot provide suitable proof as to eligibility or compliance with these Terms, they will forfeit the Gift in its entirety.
19. No responsibility is accepted for any entry that is late, lost or misdirected, or if a Winner does not claim their Gift in accordance with these Terms.
Participant’s Warranties and Indemnity
20. The Promoter is not liable for any costs and claims in connection with a failure by itself to comply with these Terms.
21. Each Participant agrees that they are fully responsible for each Entry they submit. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by the Participant in submitting their Entry.
22. This Competition is in no way endorsed, sponsored or affiliated with Myagi Software. The Promoter is not liable for any costs and claims arising in connection with a failure by Myagi Software service provider to comply with these Terms, or otherwise arising in connection with this Competition.
23. Participants agree that the Gift may be regarded as benefits in-kind and be liable to taxes, including fringe benefits tax. Participants and their employer are liable for all such taxes. The Promoter recommends that Participants and the Retail Partner obtain independent tax advice in this regard.
24. By accepting these Terms, the Participants confirm they have reviewed and accepted the policies, terms and conditions of Myagi software.
Conditions that may Invalidate Entries, Participants or the Competition
25. The Promoter reserves the right to reject, disqualify, remove, or moderate any Entry that it determines, in its sole discretion, does not fit the criteria set out in these Terms.

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to:
a. to disqualify any Participant; or
b. modify, suspend, terminate, or cancel the Competition as appropriate.
